Locum Tenens

Locum Tenens Coverage is provided for a temporary substitute physician. This coverage can be provided only when the JUA insured physician is not practicing. This coverage is not available for physicians who are scheduling other physicians to staff an emergency room. The coverage afforded by the Locum Tenens Endorsement is excess insurance should the substitute physician have other insurance applicable to the loss under the JUA policy. On an excess, contingent, or primary basis, the JUA policy will come into effect only after such other insurance has been exhausted.

New Locum Tenens Applicants
Locum Tenens applications may be obtained by the provider directly from office of the JUA Administrator or through the properly licensed resident agent of his or her choice.

Locum Tenens Physicians must submit a fully completed application and a 10 year loss history report to the JUA for approval. Loss history reports may be obtained by requesting them from the physician's current and/or prior insurance carrier(s) and from the National Practitioner Data Bank. (1-800-767-6732). Every effort will be made to advise the applicant within 48 hours if they are eligible for Locum Tenens Coverage through the JUA. If a physician is determined to be eligible, his/her application for eligibility will be marked as approved and will be effective for a period of one year.

Eligibility:

  • Physicians must be a licensed healthcare provider to be eligible for coverage.

  • Physicians who have been convicted of a State or Federal felony involving moral turpitude are not eligible for coverage.

  • Physicians who have had their hospital privileges denied, restricted, suspended, or revoked or have voluntarily surrendered such privileges or have had a probationary period invoked may not be eligible.

  • Physicians who have had their narcotics or medical license suspended, restricted, revoked, or voluntarily surrendered or have had a probationary period invoked may not be eligible.

  • Physicians who have been denied a medical license, or been denied certification by a specialty board may not be eligible.

  • Physicians who have any unpaid obligations on any professional liability policy may not be eligible.

  • Physicians who have an adverse loss history may not be eligible.

Locum Tenens Requests
Written request for this coverage must be made in advance by submitting a fully completed Locum Tenens Request Form. These forms may be obtained by the JUA Insured directly from the office of the JUA Administrator or through a properly licensed agent of their choice. Locum Tenens coverage cannot be provided on a retroactive basis if the request is made late. A separate request must be made in advance of each period of substitution.

A JUA policy may provide up to 45 days of coverage during the policy period for duly licensed substitute physicians working on behalf of the JUA Insured on a temporary basis due to vacation, illness, or other absence. An extension beyond the 45 day limitation may be obtained if there is a medical emergency or other extenuating circumstance that might prevent the JUA physician from returning to work. A request for such extension must be submitted in writing by the JUA Insured stating the reasons for such an extension and must be approved by the JUA underwriter before an extension can be granted.

Locum Tenens Endorsement
Upon receipt of a fully completed Locum Tenens Request, the JUA Underwriter will verify that the substitute physician has been previously approved by the JUA and currently meets all underwriting requirements as outlined in the aforementioned paragraphs. Upon approval of the Locum Tenens Request by the JUA Underwriter, the information will be entered into the client database and a Locum Tenens Endorsement will be issued by the JUA Underwriting Department. Copies of this endorsement will be forwarded to the parties requesting the endorsement, as well as to the JUA agent of record. A copy of the endorsement to the policy will be placed in the JUA Insured's policy file and in the Locum Tenens physician's underwriting file.
