What You Should Do

Your professional liability policy requires prompt reporting to the SCJUA if a claim or lawsuit is brought against you in practice. You are also required to promptly report to the SCJUA an occurrence, such as an unexpected outcome or the receipt of a subpoena for you testimony or records in a medical negligence case.
  • Claim - Letter from an attorney or a patient alleging negligent treatment, requesting medical records, or advising you to notify your carrier.

  • Suit - Legal action has commenced in a state or federal court. Usually you are served with a Summons or Complaint by a deputy sheriff advising that a legal action is being initiated against you. Telephone contact with the JUA should be made immediately on the date of service.

  • Occurrence - An unexpected event or adverse outcome resulting in injury or death.

  • Subpoena - Formal notice for copies of medical records or appearance at a deposition or trial circumstance.

Remember, call the Claims Department immediately at (864) 240-5400 for any of the above circumstances. In addition, do not discuss the case with anyone except an authorized representative of the SCJUA. Do not make any alterations or changes to the existing medical or office records.
